ABSTRACT. The mainstay of the paper is formed by an analysis of the moral moorings of the substantive criminal law, the basic moral norms embodied in the criminal law, and the legitimacy of the law. The findings of this study have im- plications for the fairness and rationality of substantive criminal law rules, the nature of the harms of crime, and the utility of the restorative process. pp. 166–171
